Page Seager provides services to various mortgage suppliers, which range from the initial point of mortgagor default to the enforcement of court orders to obtain vacant possession of mortgaged properties. We pride ourselves on the high quality of work produced by our practitioners and the rapport we develop with clients, fostering a strong relationship and open communication. Our practitioners ensure that options for recovery pursuant to a mortgage are comprehensively explored, including encouraging mortgagors to pay arrears due and payable on their mortgages where possible. This approach, we have found, often avoids the need to institute court proceedings thereby reducing costs and securing the desired outcome for the client.

When required, our practitioners skilfully expedite the necessary court proceedings, including drafting documents for filing with the Supreme Court, arranging service, appearing in Court to secure orders for possession, formalising orders and ultimately obtaining vacant possession of mortgaged premises, relating to both residential and commercial multi facility mortgage agreements.

In addition Page Seager offers advice and assistance to mortgagor clients and can advocate on behalf of clients with mortgagees with a view to securing the optimum outcome for the client. This includes reviewing the facility documents and documentation filed by the mortgagee with the Supreme Court and then advising the client in relation to their entitlements and obligations under the mortgage and whether any basis exists in law to resist an application for vacant possession. If required our practitioners will appear in Court proceedings on behalf of the mortgagor.

Page Seager seeks to provide cost efficient and pragmatic advice to clients regarding mortgage default work, whether on behalf of the mortgagee or the mortgagor and in relation to both commercial and residential facilities.
