Workers Compensation Case Commentaries Report – August 2020

Welcome to our latest Workers Compensation Case Commentaries Report.  It can be accessed by clicking Download below.

In this month’s case commentaries, we discuss the recent decision of the Supreme Court in Tasmania v Pilling [2020] TASSC 13 and its application in two recent decisions of the Workers Rehabilitation and Compensation Tribunal, which deals with the new requirements of disputing a claim based on s32(1)(a), being a dispute that the worker failed to give notice as soon as practicable and (b) that the worker failed to make their claim within six months of the date of injury.

Further, we also discuss the recent case of P v Circular Head Livestock Transport Pty Ltd [2020] TASWRCT 24, which confirms that a worker who has attained the person age at the time they suffer their injury cannot have their weekly payments terminated 12 months after the injury by reliance on s87.
