Overview

Joe assists his clients achieve practical and commercial outcomes when disputes arise. His primary focus is on supporting clients in engineering, building, construction and infrastructure projects. Joe regularly acts for liability insurers on building disputes.

Joe also acts in work health and safety issues including criminal matters under the Work Health and Safety Act 2012, and can assist employers following serious workplace accidents, including liaising with the regulator and attending interviews conducted by WorkSafe Tasmania.

Joe’s main focus is on:

  • dispute avoidance and risk mitigation advice and training;
  • advising on and managing construction-related claims, including claims made under Security of Payment legislation in Tasmania, Victoria and Queensland;
  • advising on and managing residential and commercial construction litigation in Courts and Tribunals in Victoria and Tasmania; and
  • employment and safety matters, including claims made by employees in the Fair Work Commission and matters arising under the Work Health and Safety Act 2012.

Experience

Examples of recent significant matters Joe has acted in include:

  • successfully acting for a major Tasmanian contractor in a significant adjudication application in a dispute surrounding defective works, delays and latent conditions;
  • acting for a major state utility to respond to an adjudication application where the key issues were delayed and contractual pre-conditions to extensions of time resulting in a claim of over $1m being reduced to less than $2,000.00;
  • acting for a contractor in a successful adjudication application and multiple subsequent related proceedings in the Supreme Court of Tasmania and the Federal Court;
  • acting for an engineer to defend an application for joinder to VCAT proceedings; and
  • acting for insurers in defence of building and construction disputes arising out of liability claims.

Joe also regularly provides training and seminars to clients of the firm.

Prior to joining Page Seager, Joe was Associate to Justice Porter in the Supreme Court of Tasmania.
