Overview

Brett understands the need for, and provides, timely and practical solutions on complex areas of law and assists in the formulation and implementation of risk mitigation strategies.

Brett has worked in legal dispute resolution for over 15 years. He works with private and government owned corporations or entities to provide advice and assistance in both non-contentious matters (probity and tendering, contract negotiation, risks and strategy) and contentious matters (contract management and dispute resolution).

Brett provides advice, training and representation in Workplace Health and Safety matters under the Tasmanian harmonised legislation. He assists in workplace investigations including communications with regulatory authorities and appears as counsel in workplace prosecutions. Brett also provides training to senior managers and boards on legislative compliance and due diligence requirements.

Experience

Brett provides strategic and dispute management advice in a timely and pragmatic manner.

Examples of matters include:

  • risk review, advice, negotiation and drafting for energy projects (solar farms, turbine construction, wind farms and hybrid renewable energy systems) in Tasmania, Queensland, South Australia and Victoria;
  • providing drafting and probity advice for large staged redevelopment projects involving the construction of civic and other use buildings and the relocation of public services as part of a $200m project and a $150m project;
  • risk review, probity and tendering advice, drafting, negotiation, contract management and dispute resolution for state and national infrastructure projects including water (pipelines, sewage and water treatment plants and storage systems), road (highway, bridges, overpasses, crossings and associated infrastructure) NBN above ground services, airport works (runways and associated infrastructure) and marinas;
  • contractual advice and negotiation of management contracts, consultancy agreements and construction agreements for multiple hotel construction and fit out projects;
  • contractual dispute matters including property (leasing and licensing), service and supply agreements (aquaculture, information technology, waste disposal) and transfer of business or asset agreements;
  • issuing or responding to security for payment claims in multiple jurisdictions for claims raising issues of contract formation, delay claims, variations and defects;
  • resolution of contractual disputes under mining and manufacture services agreements following alleged breaches and workplace accidents; and
  • providing advice and assistance for serious workplace injuries and fatalities at the investigative stages, dealings with regulatory bodies and appearance as counsel in workplace prosecutions.

Brett regularly provides seminars and training courses to principals, contractors, government and state-owned corporations in relation to the administration of construction contracts including advice concerning the Building and Construction Security of Payment Act.
