Overview

Brett understands the need for and provides timely and practical solutions on complex areas of law and assists in the formulation and implementation of risk mitigation strategies.

Brett has worked in legal dispute resolution for over 10 years. He works with private and government owned corporations by providing advice and assistance on contractual formation issues (including probity and tendering), contractual management and dispute resolution.

Brett also provides advice in relation to workplace health and safety prosecution and enforcement.

Brett provides strategic and dispute management advice in a timely and pragmatic manner.

Examples of recent significant matters include:

  • Acting for a major state utility in dispute resolution matters involving an infrastructure construction project which experienced significant delay and defects requiring arbitrational and Supreme Court intervention;
  • Providing advice and dispute assistance in relation to the administration of a 20 storey hotel construction contract requiring alternative dispute resolution procedures;
  • Providing advice and contractual drafting for a hybrid renewable energy system in South Australia;
  • Providing advice, drafting and contractual administration services for a national principal requiring construction works in over 200 sites across Australia;
  • Issuing a major security for payment claim in Victoria for a national contractor on an infrastructure project involving 35 areas of dispute relating to scope of work, variation and defect claims;
  • Providing drafting and probity advice for a major staged redevelopment project involving the construction of civic and other use buildings and the relocation of public services as part of a $200m project;
  • Providing advice and contractual drafting for a major inner city redevelopment as part of a $150m project; and
  • Resolution of a mining services contractual dispute following a mining accident involving breach of contract and delay claims.

Brett regularly provides seminars and training courses to principals, contractors, government and state owned corporations in relation to the administration of construction contracts including advice concerning the Building and Construction Security of Payment Act.

Brett is a member of the Society of Construction Law and a panel expert for the Master Builders Association of Tasmania.
